Service Provision within the Job Board Service
Welcome to 8Bit’s Job Board! These Terms and Conditions govern your access to and use of our job posting services. By using our platform, you agree to comply with these rules. Please read them carefully.
For the purposes of these Terms and Conditions:
“Service Provider” aka “8Bit” – the Service Provider and owner of the Website is the company 8Bit limited liability company (spółka z ograniczoną odpowiedzialnością), REGON: 522427770, VAT number: 9571145506.
“Job Advertiser” refers to the company or individual posting a job advertisement on the 8Bit platform.
“User” refers to any individual accessing the Job Board to explore job opportunities.
“Service” refers to the display and promotion of job advertisements provided by Job Advertisers on the 8Bit platform.
“Job Advertisement” refers to the content submitted by a Job Advertiser for posting on the platform, including but not limited to job descriptions, URLs, and contact information.
§ 1. SCOPE OF SERVICES
1.1. 8Bit provides a platform for displaying Job Advertisements submitted by Job Advertisers. These advertisements will appear on 8bitplay.com/jobs, alongside the job opportunities 8Bit is actively recruiting for as a recruitment agency.
1.2. Purchased Job Advertisements will also be included in Email Job Alerts, reaching our subscribed audience for increased visibility.
1.3. 8Bit’s role is limited to connecting Users with Job Advertisers through the URLs or email addresses provided by the Job Advertisers. 8Bit does not collect, process, or store any personal data of Users applying to job postings.
1.4. Our platform may contain links to third-party websites, such as studio career pages. 8Bit is not responsible for the content or privacy practices of these external websites.
1.5. Job Advertisements can be purchased at any time, 24/7, and will be published within a maximum of 12 business hours after submission, following a manual review process. Business hours are defined as 9:00 AM to 5:00 PM GMT+1, Monday to Friday, excluding Saturdays, Sundays, public holidays, and days statutorily free from work in Poland.
1.6. Job Advertisements will also be promoted on 8Bit’s LinkedIn company page to enhance visibility. The promotional post may aggregate multiple Job Advertisements, and the timing, format and wording will be determined by 8Bit to ensure consistency and alignment with our professional standards.
§ 2. JOB ADVERTISER RESPONSIBILITIES
2.1. Job Advertisers must provide accurate, lawful, and up-to-date information in their Job Advertisements.
2.2. If a Job Advertiser does not have an established company website, they may use an email address to collect applications.
2.3. Job Advertisements must comply with all applicable laws and regulations and must not:
– Require candidates to work for free. Unpaid internships are allowed only if they do not require prior job experience, ensuring they are genuinely entry-level opportunities. All postings must meet legal requirements for fair compensation.
– Contain defamatory, false, or misleading information.
– Include obscene, inappropriate, or pornographic content, or material classified as “not safe for work” (NSFW).
– Violate intellectual property rights, such as copyrights or database rights.
– Breach confidentiality, privacy, or data protection laws.
– Encourage, promote, or instruct on criminal activity.
– Contravene anti-discrimination laws or promote racial or religious hatred.
2.4. Job Advertisements are manually reviewed by 8Bit before being posted. This process ensures the legitimacy and fairness of opportunities listed on our platform.
2.5. 8Bit reserves the right to edit typos, grammar mistakes, or syntax errors in Job Advertisements to maintain professional standards.
2.6. We reserve the right not to publish Job Advertisements that do not align with applicable laws, regulations, or good practices. Payments for declined postings will be fully refunded.
2.7. Job Advertisements from companies that pay taxes in Russia or Belarus will not be accepted. Such submissions will be declined, and payments fully refunded.
2.8. 8Bit reserves the right to refuse the publication of a job opening if it may interfere with 8Bit’s recruitment business, including roles that 8Bit is actively recruiting for as a part of its recruitment agency services and cases where an active business partnership with a client covers the opportunity hires. Any such submissions will be declined, and payments for these listings will be fully refunded.
§ 3. Job Listings
3.1. A job posted on the Website will remain live for 30 days unless otherwise agreed upon with the Job Advertiser.
3.2. Extensions beyond the initial posting period will be charged as new postings.
3.3. Jobs posted beyond the agreed monthly quota will incur a per-job fee agreed upon during contract negotiations.
3.4. If a Job Advertiser wants to delete a job and repost it, or posts a replacement job, both actions will be treated as separate postings.
§ 4. Payments
4.1. All services must be paid for in advance via the Stripe payment service by Credit/Debit Card.
4.2. An invoice or receipt will be issued for each transaction, reflecting the details of the payment and services rendered.
4.3. The Service Provider does not charge Job Advertisers for using the payment systems available through Stripe payments.
4.4. The terms of payment execution are specified in the terms and conditions of service provision by Stripe.
4.5. The Service Provider is not responsible for the security and course of transactions made through Stripe or for the way personal data is processed by Stripe. Complaints about the course of payments made through Stripe reported to the Service Provider will be forwarded by the Service Provider for consideration by Stripe under the terms and within the time specified in the Stripe regulations.
§ 5. Data Privacy
5.1. 8Bit does not collect, store, or process personal data submitted by Users applying for Job Advertisements. All personal data is submitted directly to the Job Advertiser via the provided URL or email address.
5.2. To provide insights into the performance of Job Advertisements, 8Bit reserves the right to track the number of clicks made on the “Apply” button for each advertisement. These events will be tracked in an aggregated manner and will not be linked to any individual User.
5.3. The link provided by the Job Advertiser for applications will have UTM parameters added. This allows the Job Advertiser to track the visits they receive from 8bitplay.com using their own analytics tools, such as Google Analytics. If the Job Advertiser opts to use a link directing to a website they do not own (e.g., an ATS platform or third-party service), they acknowledge that this tracking method may not be available, and they agree to this limitation by completing the transaction.
5.4. Job Advertisers are responsible for ensuring compliance with all applicable data protection laws when handling User information submitted through their application processes.
§ 6. Limitations of Liability
6.1. 8Bit is not responsible for the content, accuracy, or legality of Job Advertisements posted by Job Advertisers.
6.2. 8Bit disclaims all liability for any disputes, damages, or losses arising from interactions between Users and Job Advertisers.
§ 7. Amendments to the Service
7.1. 8Bit reserves the right to modify, suspend, or terminate the Job Board services at any time.
7.2. If a Job Board client chooses to transition into a client for 8Bit’s recruitment services, a loyalty discount will be applied to their recruitment fees as a token of appreciation for their continued collaboration with 8Bit.
§ 8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Poland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gdańsk, Poland.
